Welcome to yci.co. These Terms and Conditions ("Terms", "Terms and Conditions") govern your use of the yci.co website and the immigration consulting services provided by YCI Canada Immigration Services Ltd. ("we", "us", "our", "YCI", or the "Company").
By accessing this website and using our services, you accept and agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, please do not use our website or services.
1. Definitions
- "Client" or "You" refers to the individual or entity accessing our website or engaging our immigration consulting services
- "RCIC" refers to Regulated Canadian Immigration Consultant(s) employed by or associated with YCI Canada Immigration Services Ltd.
- "CICC" refers to the College of Immigration and Citizenship Consultants, the regulatory body governing immigration consultants in Canada
- "Services" refers to immigration and citizenship consulting services provided by YCI
- "Website" refers to yci.co and all associated web pages, subdomains, and mobile applications
- "IRCC" refers to Immigration, Refugees and Citizenship Canada
2. About YCI Canada Immigration Services Ltd.
YCI Canada Immigration Services Ltd. is a professional immigration consulting firm providing services related to Canadian immigration and citizenship matters. Our consultants are Regulated Canadian Immigration Consultants (RCICs) who are licensed members in good standing with the College of Immigration and Citizenship Consultants (CICC).
2.1 Regulatory Compliance
- All our immigration consultants are licensed and regulated by the CICC in accordance with the College of Immigration and Citizenship Consultants Act
- We adhere to the CICC Code of Professional Conduct
- Our CICC member numbers and licensing status can be verified at college-ic.ca
- We comply with all applicable Canadian federal and provincial laws and regulations
3. Website Use and Access
3.1 License to Use
We grant you a limited, revocable, non-exclusive, and non-transferable license to access and use the yci.co website for personal, non-commercial purposes related to exploring our immigration consulting services. This license does not include:
- Resale or commercial use of the website or its contents
- Collection and use of any content, data, or information for commercial purposes
- Downloading or copying of account information for the benefit of another individual or entity
- Use of data mining, robots, web scraping, or similar data gathering and extraction tools
- Any use of the website that could damage, disable, overburden, or impair our servers or networks
3.2 Intellectual Property Rights
All content on the yci.co website, including but not limited to text, graphics, logos, images, videos, software, and compilations, is the property of YCI Canada Immigration Services Ltd. or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content without our express written permission.
3.3 Prohibited Activities
You agree not to engage in any of the following prohibited activities:
- Violating any applicable laws or regulations
- Infringing on any intellectual property rights
- Transmitting any viruses, malware, or other malicious code
- Attempting to gain unauthorized access to our systems or networks
- Interfering with or disrupting the website or servers
- Impersonating any person or entity or misrepresenting your affiliation
- Collecting or harvesting information about other users
- Using the website for any fraudulent or unlawful purpose
4. Immigration Consulting Services
4.1 Scope of Services
YCI provides professional immigration and citizenship consulting services, which may include but are not limited to:
- Initial immigration assessments and eligibility evaluations
- Immigration program recommendations and strategy development
- Preparation and submission of immigration applications to IRCC
- Document review, translation coordination, and application support
- Representation before IRCC and other immigration authorities
- Post-application support and communication with immigration authorities
- Express Entry profile creation and management
- Provincial Nominee Program (PNP) applications
- Family sponsorship applications
- Work permits, study permits, and visitor visas
- Citizenship applications and related services
Specific services will be detailed in a separate Service Agreement executed between YCI and the Client.
4.2 Service Agreement Requirement
In accordance with CICC regulations, a written Service Agreement must be executed before any immigration or citizenship consulting services are provided. The Service Agreement will specify:
- The specific services to be provided
- Professional fees and payment terms
- Client and consultant responsibilities
- Timelines and deliverables
- Terms of termination and refund policies
These Terms and Conditions supplement, but do not replace, any Service Agreement between YCI and the Client.
4.3 No Guarantee of Immigration Outcomes
IMPORTANT DISCLAIMER: YCI does not guarantee any specific outcome or result from immigration applications. Immigration decisions are made solely by IRCC and other Canadian immigration authorities based on their assessment of your application, eligibility criteria, and applicable laws and policies. While we provide professional representation and work diligently on your behalf, we cannot control or influence immigration decisions.
We do not guarantee:
- Approval of any immigration, visa, or citizenship application
- Processing times by IRCC or other government authorities
- Issuance of invitations to apply under Express Entry or Provincial Nominee Programs
- Specific point scores, rankings, or eligibility determinations
- Changes in immigration laws, policies, or program requirements
5. Client Responsibilities and Obligations
5.1 Accurate Information
You must provide complete, accurate, and truthful information at all times. You acknowledge that:
- Any inaccurate, misleading, or false information may void any Service Agreement and seriously affect the outcome of your application
- Providing false information to immigration authorities is a serious offense under Canadian law and may result in application refusal, inadmissibility, or criminal charges
- YCI's obligations under any Service Agreement are null and void if you knowingly provide inaccurate, misleading, or false information
- Your financial obligations remain even if services are terminated due to provision of false information
5.2 Document Provision
You agree to:
- Provide all requested documents, information, and forms in a timely manner
- Ensure all documents are clear, legible, and properly organized
- Provide certified translations for documents not in English or French
- Obtain and provide any required notarizations, attestations, or certifications
- Respond promptly to requests for additional information or clarification
- Notify YCI immediately of any changes in your circumstances that may affect your application
5.3 Communication and Cooperation
You agree to:
- Maintain regular communication through agreed channels (email, WhatsApp, Microsoft Teams, phone, etc.)
- Check your email and messages regularly for important updates
- Respond promptly to communications from YCI and immigration authorities
- Attend scheduled meetings, consultations, and appointments
- Not contact IRCC or other authorities impersonating or using the RCIC's name and contact details
- Not solicit advice on behalf of other individuals not party to your Service Agreement
5.4 Independent Decision-Making
While we provide professional advice and recommendations, you retain full decision-making authority regarding your immigration matters. You are responsible for making informed decisions about which immigration programs to pursue and whether to proceed with applications.
6. Fees, Payment, and Refunds
6.1 Professional Fees
Professional fees for immigration consulting services will be specified in your Service Agreement. Fees may include:
- Initial consultation fees
- Assessment and eligibility review fees
- Application preparation and submission fees
- Representation and communication fees
- Hourly rates for additional services beyond the agreed scope
6.2 Government Fees and Disbursements
In addition to professional fees, you are responsible for:
- All government processing fees payable to IRCC and other authorities
- Third-party costs including translation, notarization, medical examinations, police certificates, courier services, and credential assessments
- These fees are separate from YCI's professional fees and are non-refundable
6.3 Payment Terms
- Payment terms will be specified in your Service Agreement
- Payment may be required in installments or as a retainer before services commence
- We accept payment via e-transfer, credit card, bank transfer, or other agreed methods
- All fees are in Canadian Dollars (CAD) unless otherwise specified
- Late payments may result in suspension of services
6.4 Refund Policy
Refund terms will be specified in your Service Agreement. Generally:
- If YCI does not complete the tasks identified in the Service Agreement, a partial or full refund of professional fees may be provided
- Refunds are strictly limited to professional fees paid to YCI and do not include government fees or third-party disbursements
- Refunds will not be provided if services are terminated due to client-provided false information or failure to cooperate
- Processing times and immigration decisions by authorities do not constitute grounds for refunds
7. Communications and Technology
7.1 Electronic Communications
By using our services, you consent to receive communications from YCI via:
- Email (Microsoft 365 email services)
- WhatsApp Business
- Microsoft Teams video calls and chat
- Text messages (SMS)
- Phone calls
- Social media platforms (Facebook Messenger, Instagram, LinkedIn)
- Our website contact forms and client portal
You agree that electronic communications satisfy any legal requirement that communications be in writing.
7.2 Document Storage
Your documents and personal information are stored securely using Microsoft 365 and OneDrive for Business cloud storage solutions. By engaging our services, you consent to the storage of your information in accordance with our Privacy Policy.
7.3 Communication Security
While we implement reasonable security measures, you acknowledge that:
- Electronic communications are not completely secure
- You assume the risk of using email, text messages, and other electronic communication methods
- We recommend using secure channels (Microsoft Teams, encrypted email, secure portal) for highly sensitive information
8. Confidentiality and Privacy
8.1 Confidentiality
YCI maintains strict confidentiality of all client information in accordance with the CICC Code of Professional Conduct. We will not disclose your information except:
- When required to submit applications to IRCC and other immigration authorities
- With your express written consent
- When required by law, court order, or regulatory obligation
- To third-party service providers under confidentiality agreements (translators, medical examiners, etc.)
- To CICC for regulatory compliance, audits, or investigations
8.2 Privacy Policy
Your use of our website and services is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data collection, use, and protection practices.
8.3 Data Retention
As required by CICC regulations, we must retain client files for a minimum of 7 years after case completion. You acknowledge that data deletion requests must comply with these regulatory requirements.
9. Limitations of Liability and Disclaimers
9.1 Website Disclaimer
The yci.co website and all information provided are on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
9.2 Information Accuracy
While we strive to provide accurate and up-to-date information on our website:
- Immigration laws, policies, and procedures change frequently
- Website content is for general informational purposes only and does not constitute legal advice
- You should not rely solely on website information for immigration decisions
- We recommend consulting with an RCIC for personalized advice based on your specific circumstances
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- YCI, its directors, officers, employees, agents, and consultants shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services
- Our total liability for any claims arising from our services shall not exceed the professional fees paid to YCI for those services
- We are not liable for delays, failures, or losses caused by immigration authorities, government policy changes, processing backlogs, or circumstances beyond our reasonable control
- We are not liable for losses resulting from your failure to provide accurate information, respond to communications, or comply with your obligations
9.4 Force Majeure
YCI is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, labor disputes, internet or technology failures, or changes in immigration laws and policies.
10. Termination
10.1 Termination by Client
You may terminate your Service Agreement in accordance with the termination provisions specified in that agreement. You remain responsible for fees for services already provided and any non-refundable expenses incurred.
10.2 Termination by YCI
YCI may terminate services under the following circumstances:
- Non-payment of fees after reasonable notice
- Your failure to provide required information or documents
- Your provision of false or misleading information
- Material changes that make it impossible to proceed with services
- Conflict of interest that cannot be resolved
- Your breach of these Terms and Conditions or the Service Agreement
- Circumstances where continuing representation would violate professional or ethical obligations
In accordance with CICC regulations, we may withdraw representation upon written notice, provided withdrawal does not cause prejudice to you.
10.3 Website Access Termination
We reserve the right to suspend or terminate your access to the yci.co website at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
11. Indemnification
You agree to indemnify, defend, and hold harmless YCI Canada Immigration Services Ltd., its officers, directors, employees, agents, and consultants from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:
- Your use of the website or services
- Your violation of these Terms and Conditions
- Your provision of false, inaccurate, or misleading information
- Your violation of any rights of third parties
- Your violation of any applicable laws or regulations
12. Third-Party Links and Services
Our website may contain links to third-party websites and resources, including IRCC, provincial immigration websites, credential assessment organizations, and other service providers. These links are provided for convenience only. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites. You access third-party websites at your own risk.
13. Changes to Terms and Conditions
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the yci.co website with an updated "Last Updated" date. Your continued use of the website or services after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
Material changes may be communicated via email or through prominent notices on our website.
14. Governing Law and Jurisdiction
These Terms and Conditions and any Service Agreements shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada. However, we retain the right to seek injunctive or other equitable relief in any jurisdiction.
15. Dispute Resolution
15.1 Internal Resolution
If you have a complaint or dispute regarding our services, we encourage you to first contact us directly to seek resolution. We are committed to addressing concerns professionally and promptly.
15.2 CICC Complaints Process
If you are unable to resolve a dispute with YCI directly, you have the right to file a complaint with the College of Immigration and Citizenship Consultants (CICC). Information about the complaints process is available at college-ic.ca.
16. Severability
If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
17. Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
18. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and any executed Service Agreement, constitute the entire agreement between you and YCI Canada Immigration Services Ltd. regarding the use of our website and services, and supersede all prior or contemporaneous communications and proposals, whether oral or written.
19. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. YCI may assign these Terms and any Service Agreement without restriction.
20. Language
These Terms and Conditions are provided in English. If a translation is provided for convenience, the English version shall prevail in case of any conflict or discrepancy.
